Procedural Posture

Contempt Application / Ruling on Contempt Motion

  1. 1 Whether the respondents wilfully disobeyed the court order of 22 March 2019 to reinstate the applicant's salary and employment benefits.
  2. 2 Whether the partial payment of salary during suspension constituted contempt of court.

Ratio Decidendi

The court found that the applicant was initially on compulsory leave pursuant to a presidential proclamation, during which he was entitled to full salary and allowances. However, after being suspended for failing to comply with the directive, his employment terms changed, and the applicable Human Resources Management Policies and Procedures Manual allowed for only partial salary during suspension. The court held that the respondents' actions in paying only part of the applicant's salary were consistent with the Manual and did not amount to wilful disobedience of the court order. As such, the threshold for contempt was not met, and the application for contempt was dismissed.

Court Disposition

application dismissed

Orders

  • The motion for contempt is dismissed.
