RULING
1. On 16th March, 2017 the plaintiff was ordered to comply with order, 11, CPR within 14 days.
2. Instead of complying with order 11, of the Civil Procedure Rules, on 30th March, 2017 the plaintiff filed a notice to withdraw the suit. The notice was dated 30th March, 2017. The notice indicated that it had been copied to Tartisio Ngai Nderi, the defendant.
3. This suit is marked as withdrawn and is to be marked as such in the register of cases.
4. Costs are awarded to the defendant.
5. It is so ordered.
