The Respondent failed to provide the Claimant with written notice and did not afford him an opportunity to be heard as required by sections 35(1)(c) and 41 of the Employment Act, 2007. The evidence did not demonstrate that the Claimant was given a fair hearing or that procedural requirements were met.
