The court found that the caution on land parcel NO KIMILILI/KIMILILI/2303 was wrongly placed. The file from KAKAMEGA HIGH COURT CIVIL CASE No 24 of 1994, which was cited as the basis for the caution, related to a different parcel of land and did not contain any order for a caution to be placed on the applicant's land. Furthermore, that suit was dismissed for want of prosecution. There was no legal justification for the caution, and the Land Registrar provided no response or evidence to the contrary. The court therefore ordered the immediate removal of the caution and summoned the Land Registrar to explain the basis for the action.
