Ratio Decidendi

The court held that the Supreme Court's decision in Muruatetu is expressly limited to mandatory sentences for murder under section 204 of the Penal Code and does not extend to other offences such as defilement under the Sexual Offences Act. Consequently, the High Court has no jurisdiction to review the applicant's sentence for defilement on the basis of the Muruatetu decision. Furthermore, any arguments regarding the reckoning of time spent in custody should have been raised during the appellate process, and since the appellate courts did not address or grant such relief, the High Court cannot entertain the petition. The application was therefore struck out as incompetent.
