The Petitioner was excluded from plot 417 because he had contributed to the purchase of plot 753, which was registered in the deceased's name but acquired jointly with the Petitioner. The court accepted the Petitioner's evidence, corroborated by other witnesses, that he contributed half the purchase price for plot 753 and that plot 592 was purchased solely with his own funds and never formed part of the deceased's estate.
