Ratio Decidendi

The court found that there were no express admissions by the Defendant in the defence or in the correspondences relied upon by the Applicant. The letters from Nairobi City Council and Nairobi City County did not constitute unequivocal admissions of the Applicant's claim. Furthermore, the Respondent's defence raised triable issues, particularly regarding the circumstances of the allocation of the suit property and whether it had already been built up as part of Kiambiu Village at the time of allocation. As such, the application for judgment on admission and for striking out the defence lacked merit and was dismissed with costs to the Respondent.
