The court held that the role at this stage is not to determine whether the defence will ultimately succeed but to assess whether it raises triable issues that warrant a full trial. The defence raised by the 1st Defendant, including questions about the Plaintiff's knowledge of the stolen cheque, the circumstances of the criminal prosecution, and the effect of the withdrawal of charges, constitute triable issues. As such, the defence cannot be said to be so hopeless as to warrant being struck out. The application to strike out the defence therefore fails, and the matter should proceed to full trial for determination of the substantive issues.
