The appellant’s actions were motivated by a genuine interest in recovering his stolen property, not by malice or recklessness. The respondent failed to prove three of the four required ingredients for malicious prosecution, namely, lack of reasonable or probable cause, malice, and that the appellant instigated the prosecution.
