Ratio Decidendi

The court found that the respondent failed to comply with the mandatory procedural requirements under section 41 of the Employment Act, 2007, by not providing the claimant with notice or a hearing prior to termination. Although the claimant's performance was in question, the lack of procedural fairness rendered the termination unfair and unlawful. Considering the claimant's short period of service (about 8 months) and the respondent's concerns about performance, the court awarded compensation equivalent to three months' salary, pay in lieu of notice, and payment for days worked. The claimant was also entitled to a certificate of service as a statutory right.
