Ratio Decidendi

The High Court found that the trial magistrate erred in principle by imposing the maximum fine on a first offender without aggravating circumstances and by drawing a negative inference from the appellant's silence during mitigation. The court held that the appellant's silence could not lawfully be interpreted as lack of remorse, particularly given his congenital condition affecting speech. The sentence was therefore unlawful and disproportionate. The High Court set aside the original sentence and substituted it with a fine of Kshs.30,000 or three months' imprisonment in default, and ordered a refund of the excess fine already paid.
