Ratio Decidendi

The court found that although the custodial sentence imposed by the trial court was legal, it was harsh and excessive given the circumstances. The trial court failed to consider that the Applicant was in possession of a small quantity of narcotic drugs for personal consumption and not for trafficking. The law treats possession for personal use more leniently than trafficking. The Applicant had already served approximately twenty months in prison, which the court deemed sufficient punishment. Therefore, the sentence was revised to the period already served, and the Applicant was ordered to be released unless otherwise lawfully held.
