Legal Issues
- 1 Whether the previous sentencing order required revision in light of Section 67(12) of the Prisons Act.
- 2 Whether the accused, being a child, should be committed to a youth corrective centre for rehabilitation.
Ratio Decidendi
The court found that its previous order required revision to comply with Section 67(12) of the Prisons Act, which mandates that juvenile offenders be committed to youth corrective centres for rehabilitation. The judge, guided by the probation officer's report and the statutory framework, determined that the accused, being a child, should be sent to Kamiti Youth Corrective Centre for a period of four months. This approach aligns with the rehabilitative objectives of juvenile justice and ensures the child's best interests are served, rather than subjecting the minor to punitive measures intended for adults.
Court Disposition
Previous order revised; accused committed to Kamiti Youth Corrective Centre for four months.
Orders
- The accused is committed to Kamiti Youth Corrective Centre for rehabilitation for a period of four months from the date of the order.
- The subject child to be escorted under guard to the said correction centre forthwith.
