Both the plaintiff and the 1st defendant's mother held letters of allotment dated the same day, but the 1st defendant's mother had taken possession and occupied the land since 1990, while the plaintiff had not. In the absence of fraud and with possession established, the 1st defendant's mother's interest took priority. The 1st defendant, deriving his interest from his mother, was not a trespasser. The plaintiff failed to prove her case and was not entitled to the reliefs sought. Costs were awarded to the 1st defendant as the successful party.
