The Plaintiff did not oppose the application or appear at the hearing, and therefore did not demonstrate any prejudice that would be suffered if the stay was granted. The court held that it was fair and just to stay the proceedings to allow the appeal to be heard, as this would not prejudice the Plaintiff beyond a compensable delay. Granting the stay would also serve judicial economy by avoiding unnecessary proceedings if the appeal succeeded. Accordingly, the application for stay of proceedings was granted as prayed.
