The court found that while the Respondent had a valid reason to terminate the Claimant's employment for misuse of an official vehicle, the disciplinary process was procedurally flawed because the Claimant was not informed of her right to be accompanied by a union official or colleague as required by Section 41 of the Employment Act. As a result, the summary dismissal was reduced to normal termination. The Claimant was awarded one month's salary in lieu of notice and two months' salary as compensation for unfair termination. Claims for annual leave allowance and loss of income were dismissed due to lack of evidence. No order as to costs was made.
