Ratio Decidendi

The court found that although the Land Dispute Tribunal had jurisdiction to determine disputes relating to occupation and use of land, the adoption of its award by the magistrate's court on 15th September 2011 was unlawful because the Land Dispute Tribunal Act had already been repealed by the commencement of the Environment and Land Court Act on 30th August 2011. Therefore, the magistrate's court lacked jurisdiction to adopt the award, rendering the adoption null and void. The appeal succeeded on this ground, and the orders adopting the tribunal award were set aside.
