Ratio Decidendi

The court found that the application for dismissal for want of prosecution was premature because only two months had elapsed since the last court appearance, whereas Order 17 Rule 2 requires at least one year of inactivity. However, the court held that the suit had abated as against the 1st defendant because no substitution was made within one year of his death, as required by Order 24 Rule 4(3) of the Civil Procedure Rules. The application thus succeeded only to the extent that the plaintiff's suit against the 1st defendant had abated, but not for dismissal for want of prosecution against the other defendants.
