Ratio Decidendi

The tribunal found that there was sufficient evidence on record, including affidavits of service and WhatsApp screenshots, to support that service of summons was effected on the applicant. However, the applicant's draft defence raised a triable issue by asserting that he had repaid all amounts owed to the claimant. Applying the principle that a triable issue warrants setting aside an ex-parte judgment to allow the matter to be heard on its merits, the tribunal exercised its discretion to set aside the ex-parte judgment. The tribunal also ordered the applicant to pay thrown away costs to the respondent and directed the parties to proceed to pre-trial and file necessary pleadings.
