Ratio Decidendi

The Tribunal found that the Claimant had advanced a loan of Kshs. 288,694 to the Respondent, who defaulted with a remaining principal of Kshs. 137,530 as of 22.08.2016. Interest charged at 12% per annum from the date of default to the date of filing, amounting to Kshs. 82,518, did not violate the In Duplum Rule, as the interest did not exceed the outstanding principal. The Respondent did not contest the claim, and the Claimant's evidence was unchallenged.
