The trial court's award of Kshs. 350,000 as general damages was deemed excessive in light of comparable case law and the actual injuries sustained. The High Court exercised its discretion to interfere with the quantum, reducing the general damages to Kshs. 200,000, less 20% contributory negligence as previously agreed by consent, resulting in a net award of Kshs. 160,000.
