Procedural Posture

Land Dispute / Formal Proof Judgment After Interlocutory Judgment Due to Non Appearance

  1. 1 Whether the Plaintiff is entitled to exclusive possession of the suit land by means of a permanent injunction restraining the Defendant from interfering with the land.
  2. 2 Whether the Plaintiff has proved ownership of the suit land and entitlement to the reliefs sought.

Ratio Decidendi

The Plaintiff, as the registered proprietor of the suit land, holds an indefeasible title under the Land Registration Act. The Defendant neither challenged the Plaintiff's title nor provided any evidence of fraud, misrepresentation, or illegality. The Plaintiff's evidence, including the title deed, official search, and surveyor's report, established her ownership and the Defendant's encroachment. The law protects the Plaintiff's right to exclusive possession and enjoyment of the land. The court found that the Plaintiff had proved her case on a balance of probabilities and was entitled to the permanent and mandatory injunctions sought, as well as costs.

Court Disposition

Judgment for the Plaintiff as prayed with costs.

Orders

  • A mandatory injunction ordering the Defendant to demolish and remove all structures illegally erected on the suit land, failing which the Plaintiff may do so at her own expense and recover costs from the Defendant.
