The Court found that while the Plaintiffs have been in occupation of the suit lands since before 1992, their occupation prior to the confirmation of the grant in 1992 was with the permission of the late Gatete Gatumuta and his son. Adverse possession could only begin to run from 1992, when the grant was confirmed and the suit lands were distributed to the 1st Defendant. However, the period was interrupted in 1998 when the 1st Defendant obtained eviction orders, which remained in force until they expired in 2010. Time for adverse possession thus stopped running from 1998 to 2010 and only resumed thereafter. As a result, the requisite 12-year period for adverse possession had not lapsed by...
