The trial court also failed to recognize that the orders dismissing the previous suit in Nakuru HCCC No 416 of 1997 were still valid and unchallenged. While the issue of limitation was contested and required factual determination, the attempt to relitigate a matter already dismissed by a superior court without proper procedure rendered the plaint fatally defective.
