The plaintiff's claim of unlawful debiting of his bank account could not be entertained without joining the bank as a party, as the defendant could not unilaterally access or debit the plaintiff's account. The court was satisfied that the defendant was the proper assignee of the chattels mortgage, supported by documentary evidence and the provisions of Section 45 of the Chattels Transfer Act. The argument that the chattels mortgage was limited to KES 6.5 million did not entitle the plaintiff to an injunction, as he had not shown payment of the amount due....
