Ratio Decidendi

The court found that since it is undisputed that Sitati, J dismissed the Plaintiff's application for review and the application and replying affidavit are available, there is no cause to order a re-hearing. The absence of the ruling does not prevent the extraction of an order, which can be used in the intended appeal. The court emphasized that a first appeal is a re-hearing and the Court of Appeal should be able to deal with the matter notwithstanding the absence of the ruling. Therefore, the Plaintiff's application for a re-hearing was denied.
