Ratio Decidendi

The court found that the plea was unequivocal, properly taken, and that the appellant understood the proceedings through an interpreter. The trial magistrate adhered to the correct procedure in plea taking. However, the trial court erred in imposing a default sentence of two years imprisonment for non-payment of the fine, as the Wildlife Conservation and Management Act, 2013, does not provide for a default sentence. Instead, the Penal Code scale should have been applied, resulting in a maximum default sentence of 12 months imprisonment for each count. The appeal therefore succeeded only to the extent of correcting the default sentence; the conviction and fines were otherwise upheld.
