Procedural Posture

Miscellaneous Application / Ruling on Application to Transfer Suit From Magistrate's Court to Environment and Land Court

  1. 1 Whether the Chief Magistrate's Court has jurisdiction to hear the dispute based on the value of the subject matter.
  2. 2 Whether the Applicants have established sufficient grounds for the transfer of the suit to the Environment and Land Court.

Ratio Decidendi

The court found that the subject matter of the dispute was a single room constructed on the Suit Property, not the entire property valued at Kshs. 68,000,000. There was no evidence that the Respondent was laying claim to the whole property or that the dispute involved ownership of the entire parcel. The value of the room in question was not shown to exceed Kshs. 20 million, which is within the pecuniary jurisdiction of the Chief Magistrate's Court. Therefore, the application to transfer the suit to the Environment and Land Court lacked merit as the Magistrate's Court had jurisdiction to hear and determine the matter. The application was dismissed with costs to the Respondent.
