Ratio Decidendi

The court found that the defendants failed to prove that they advanced the alleged Kshs. 3,000,000/- loan to the plaintiff. The only loan advanced was Kshs. 140,000/-, for which the plaintiff provided his title as security. The registration of a charge for Kshs. 3,000,000/- was therefore fraudulent and unsupported by consideration, rendering it null and void ab initio. The court declared the charge invalid, ordered its cancellation, and directed the return of the plaintiff's title. As the plaintiff did not prove actual loss or specific damages from deprivation of the title, only nominal damages were awarded. The court also awarded costs and interest on nominal damages to the plaintiff.
