Ratio Decidendi

The High Court found that the trial court erred by failing to conduct an enquiry into the applicant's ability to pay the fine, as required by law. The sentence of Kshs 45,000/- was manifestly excessive given the applicant's monthly earnings and status as a first offender. Additionally, the default custodial sentence of 14 days was not authorized by law; the correct default sentence should have been 6 months imprisonment as per section 28(2) of the Penal Code. These misdirections entitled the High Court to interfere with the sentence. The court therefore reduced the fine to Kshs 20,000/- in default to serve 6 months imprisonment.
