The court found that although the Claimant was given more than one month's notice prior to termination, the Respondent failed to pay the required redundancy dues as mandated by Section 40 of the Employment Act, 2007. The absence of evidence of payment of severance and other terminal dues, coupled with the Respondent's failure to participate in the proceedings or contest the Claimant's evidence, led the court to conclude that the termination was procedurally unfair. The court awarded the Claimant severance pay for five years of service and three months' salary as compensation for unfair termination, less statutory deductions, and ordered the Respondent to pay costs and interest.
