The Court further held that unless stay is granted, there is a real risk that the suit property could be transferred or disposed of, rendering the appeal nugatory if successful. The applicants thus satisfied both limbs required for the grant of stay under Rule 5(2)(b) of the Court of Appeal Rules. Consequently, the Court allowed the application and granted a stay of execution of the judgment and further proceedings pending the hearing and determination of the intended appeal.
