The tenant's claim for damages of Kshs 20,000 was dismissed for lack of evidence. The Tribunal acknowledged the tenant's rent arrears and, given the landlord's non-opposition, granted the tenant thirty days from the date of the ruling to clear all outstanding rent, failing which the landlord would be at liberty to levy distress.
