Ratio Decidendi

The court held that it cannot order the transfer of Machakos CMCC No. 1151 of 2013 to itself because the subordinate court had already determined that it lacked pecuniary jurisdiction to hear the matter. Section 18(1)(b) of the Civil Procedure Act only permits transfer of suits that were initially filed in a court with competent jurisdiction. Since the Chief Magistrate's Court found it lacked jurisdiction due to the value of the subject matter, the suit cannot be transferred. The court further noted that the suit was not struck out and remains pending at the Chief Magistrate's Court.
