The court found that the Respondent failed to comply with both statutory and contractual procedural fairness requirements before summarily dismissing the Claimant for insubordination. The Claimant was not informed of the charges against him, was not afforded an opportunity to make representations, and there was no evidence that the Respondent followed its own disciplinary procedures. Section 41(2) of the Employment Act, 2007 protects employees from summary dismissal without a hearing, and the Respondent's actions amounted to an ex parte dismissal.
