Ratio Decidendi

There was no evidence presented to demonstrate that the land was trust land. Conversely, the plaintiff provided sufficient evidence of purchase, payment, and the 1st defendant's status as registered proprietor. The court held that the plaintiff had proved his claim on the required standard, and the 2nd defendant's counter-claim was without merit. The plaintiff was entitled to the orders sought, including transfer of the land and removal of the caution.
