Ratio Decidendi

The Plaintiffs were declared bona fide owners of the sub-divisions arising from L.R. No. 12715/502 by a prior judgment. However, the mother title remains in the name of Syokimau Farm Limited, which was not previously a party to the suit. Since the Defendants cannot effect the transfer, and Syokimau Farm Limited has not opposed the application, the court finds it just and necessary to enjoin Syokimau Farm Limited as an Interested Party and order it to execute the requisite transfer documents. In the event of default, the Deputy Registrar is authorized to execute the documents to give effect to the judgment and decree.
