The High Court held that the trial magistrate erred in applying the limitation period under the Public Authorities Limitation Act to Kenya Wildlife Service (KWS), as KWS is a body corporate and not part of the government for purposes of that Act. The correct limitation period for tort claims against KWS is three years under the Limitation of Actions Act. The appellant's suit against KWS was therefore filed within time.
