Ratio Decidendi

The court held that while the Land Disputes Tribunal is empowered to determine disputes relating to trespass to land, it does not have the statutory authority to order eviction or compensation for developments arising from such findings. Such orders fall within the exclusive jurisdiction of the courts of law. Consequently, the Tribunal's award directing the respondent to vacate the land and for compensation to be assessed and paid was ultra vires and therefore invalid. The court set aside the Tribunal's award on this basis.
