The court found that the dispute between the parties is fundamentally about unfixed boundaries between adjacent parcels of land. Section 18 of the Land Registration Act expressly prohibits the court from entertaining boundary disputes unless the boundaries have first been determined by the Land Registrar and Surveyor. Therefore, the court declined to grant the injunctive relief sought by either party and instead directed the Machakos Land Registrar and District Surveyor to visit the parcels in question, prepare a report, and fix the boundaries within sixty days. The court further ordered that the status quo be maintained, prohibiting any party from cutting down trees or fixing boundaries...
