The omission rendered the charge a nullity, and as such, the conviction and sentence based on it could not stand. The court further held that ordering a retrial would unfairly allow the prosecution to correct its mistake, which is not the purpose of a retrial. Consequently, the appeal was allowed, the conviction quashed, and the sentence set aside.
