The court found that the proceedings leading to the applicant's conviction and sentence were irregular, particularly regarding the recording and handling of the change of plea. The trial magistrate erred by penalizing the applicant for procedural irregularities attributable to the court itself. Given these defects, the conviction and sentence could not safely stand.
