There was no evidence of a disciplinary hearing or sufficient proof of the alleged misconduct. The Respondent did not prove that the Claimant was given notice or paid salary in lieu of notice, nor that he took or was paid for accrued leave. The Claimant was thus entitled to one month’s salary in lieu of notice, payment for accrued leave for 5.5 years, and compensation for unfair termination. The claim for gratuity was denied as the Claimant was a member of NSSF, and the claim for overtime was dismissed due to lack of sufficient proof....
