Ratio Decidendi

The court found that it lacked jurisdiction to grant an injunction based on a consent order from the Court of Appeal, as no stay of execution had been issued in the present cause. The respondent's application to restrain execution was therefore an abuse of court process. Since the respondent irregularly stopped the execution process by relying on a consent order not issued by this court, the respondent is liable to pay the auctioneer's costs. The claimant was entitled to proceed with execution in the absence of a stay, and the auctioneer acted on valid warrants. The respondent cannot benefit from its own irregularity in halting the process.
