  3. 3 Whether the evidence supported a conviction for attempted murder or a lesser offence.

Ratio Decidendi

The court found that while the appellant did introduce poison into the complainant's food and maize flour, the evidence did not establish beyond reasonable doubt that he intended to cause death, as required for a conviction of attempted murder. The Government Analyst's report only confirmed that the substances could cause harm if ingested, not that death was likely or intended. Therefore, the prosecution proved the offence of attempted poisoning under Section 236 of the Penal Code, not attempted murder. The conviction for attempted murder was quashed and substituted with a conviction for attempted poisoning, and the sentence was reduced accordingly.

Court Disposition

Conviction for attempted murder quashed; conviction for attempted poisoning substituted; sentence reduced to 5 years imprisonment.

Orders

  • Conviction for attempted murder is quashed.
  • Conviction for attempted poisoning under Section 236 of the Penal Code is substituted.
