This violated the mandatory procedural requirements under Section 41 of the Employment Act, 2007. The Respondent also failed to establish a valid reason for the dismissal as required by Section 43. The court held that the summary dismissal was therefore wrongful, unlawful, and unfair under Section 45 of the Act.
