The court found that the Claimant's employment was verbally terminated by the 2nd Respondent on 8/12/2008, as corroborated by the Claimant's unchallenged testimony and subsequent correspondence. The Respondents failed to follow due process as required by Section 41 of the Employment Act, 2007, by not notifying the Claimant of the reasons for termination or affording him a hearing. The termination was therefore unfair under Section 45 of the Act. The Claimant was only entitled to one month's salary in lieu of notice as per his contract, not three months as claimed. He was not entitled to service gratuity since he was a member of the Social Security Fund. The claim for commissions failed...
