Legal Issues
- 1 Whether the judgment should be written by the magistrate who heard all the evidence after his transfer.
- 2 Whether it is proper to proceed in the absence of a recalled witness who cannot be availed.
Ratio Decidendi
The court determined that since Hon. Ndege had heard all the evidence, including the defence, and only the recall of a witness remained unresolved due to the witness's unavailability, it was proper and in the interests of justice for the file to be placed before Hon. Ndege for the writing of the judgment based on the evidence already recorded. This approach ensures compliance with the Criminal Procedure Code and preserves the integrity of the trial process, as the magistrate who heard the evidence is best placed to assess credibility and make findings of fact.
Court Disposition
File to be placed before Hon. Ndege for judgment based on evidence recorded.
Orders
- The file shall be placed before Hon. Ndege for writing of the judgment based on the evidence he had recorded earlier.

CRIMINAL REVISION NO.27 OF 2017

REVIEW ORDER
This file has been placed before me based on the letter dated 4/8/2017 written by Hon. Ndege. Hon. Ndege took all the evidence by the witnesses in this case including the defence. After the close of the defence case, the magistrate sought to recall PW4. After that, the magistrate was transferred from this station. The case was mentioned severally by other magistrates and the prosecution has indicated that it is not able to avail the said witness. Since the case was determined by Hon. Ndege, it is only proper that this file be placed before him for writing of the judgment based on the evidence he had recorded earlier.
It is so ordered.
Dated, Signed and Delivered at Nyahururu this 19th day of December, 2017.
