The Plaintiff established, through uncontroverted evidence, that he is the registered proprietor of land parcel KERICHO/MANARET/1198. The 2nd Defendant fraudulently registered the land in his own name and purported to sell it to the 1st Defendant, but the Land Registrar's investigation led to the cancellation of the fraudulent registration and restoration of the Plaintiff's title. The 1st Defendant, having no legal right or title, is a trespasser on the suit land. The Plaintiff is entitled to protection of his proprietary rights under the Land Registration Act and the Constitution. The absence of any defence or contrary evidence from the Defendants further supports the Plaintiff's case....
