Ratio Decidendi

The court found that the Respondent failed to issue a formal dismissal letter and did not provide the Claimant with notice that termination for abscondment was being considered. The Respondent's assertion that the Claimant absconded duty was not supported by evidence of proper notice. The court concluded that the Respondent terminated the Claimant's employment without justifiable cause and in violation of due procedure. Consequently, the Claimant was entitled to compensation for unfair termination, salary in lieu of notice, and salary for days worked. The claim for house allowance was dismissed as payslips showed it had already been paid.
